  1. This statement is misleading. While it has never been illegal to use the Bible in say, comparative religion and social studies classes, it has been illegal to teach creationism in science classes.

Generally speaking, it's indeed perfectly legal to teach ABOUT the Bible and this is done often without complaint from anyone, as the Bible is an important cultural and literary text in the Western world. However, it is flat-out unconstitutional to teach the Bible as if it were a literal, scientific truth that all students must accept, and this is generally what those who make this argument really support.

A public school teacher who teaches creationism in a public school on school time contrary to the curriculum he/she has been given has, in fact, derelicted their duty as a state employee, and stands to be fired for it, but this is indeed not a crime of any sort. It it most certainly, however, a tort of negligence. Which means that technically, it is "against the law". Just not against criminal law. Jack Chick is famously ignorant of how anything works outside a charismatic church.
    1. Note that this would be true regardless of what the actual deviation from the curriculum is, and is not specific to creationism. The role of a teacher is predicated on following their curriculum, to the benefit of their students. Deviating from the curriculum is therefore by definition a breach causing harm.
